These Terms of Service ("Terms") govern your access to and use of NFC Tagify's platform and services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organisation, you agree to these Terms on behalf of that organisation.

1. The Service
NFC Tagify provides a SaaS platform for creating and managing digital business cards, including NFC card ordering, QR code generation, profile templates, team management, and analytics tools.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

2. Accounts
2.1 Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.
2.2 Account Security
You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@nfctagify.com if you suspect unauthorised access to your account.
2.3 Accurate Information
You agree to provide accurate, current, and complete information when creating your account and to keep it updated.

3. Subscriptions and Billing
3.1 Plans
The Service is offered on subscription plans as described on our pricing page. Features and limits vary by plan.
3.2 Billing
Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as described in our Refund Policy.
3.3 Trials
Free trials are offered at our discretion. At the end of a trial, your account will revert to the free tier unless you add a payment method and subscribe.
3.4 Price Changes
We will give you at least 30 days' notice before increasing subscription prices. Continued use after the notice period constitutes acceptance of the new pricing.
3.5 Late Payments
Failure to pay may result in service suspension. Accounts suspended for non-payment for more than 60 days may be terminated and data deleted.

4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Upload, transmit, or share content that is defamatory, offensive, obscene, or violates third-party rights
- Attempt to access accounts or data that do not belong to you
- Reverse-engineer, decompile, or extract source code from the Service
- Use the Service to send unsolicited commercial communications (spam)
- Resell or sublicense access to the Service without our prior written consent (except through our Reseller Programme)
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to probe, scan, or test the vulnerability of our systems
Violation of this policy may result in immediate account termination without refund.

5. Your Content
5.1 Ownership
You retain ownership of all content you upload or create on the Service ("Your Content"), including profile data, images, and custom templates.
5.2 Licence to Us
By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, display, and transmit Your Content solely to provide the Service.
5.3 Responsibility
You are solely responsible for Your Content and ensuring it does not violate any laws or third-party rights.
5.4 Public Profiles
Profile pages you choose to make public are accessible to anyone with the link. You control this setting within your account.

6. Intellectual Property
All intellectual property in the Service — including software, design, trademarks, and documentation — belongs to NFC Tagify or its licensors. Nothing in these Terms grants you any right in our intellectual property except the limited right to use the Service as described here.

7. Third-Party Services
The Service integrates with third-party services (Stripe, Shopify, Google Analytics, etc.). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability
To the maximum extent permitted by law, NFC Tagify's total liability to you for any claims arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

10. Indemnification
You agree to indemnify and hold harmless NFC Tagify and its directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination
11.1 By You
You may cancel your subscription and delete your account at any time from the Settings page.
11.2 By Us
We may suspend or terminate your account if you violate these Terms, fail to pay, or if we are required to do so by law. We will provide reasonable notice where possible.
11.3 Effect of Termination
Upon termination, your right to use the Service ends. We will retain your data for 90 days after termination before permanent deletion, during which you may export it.

12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.
